The Clarity Act, also known as H.R. 3633, passed the House in July 2025 but has been shelved in the Senate as lawmakers prioritize other issues, such as a Russia sanctions bill and federal nominations. A significant sticking point is the ethics provision that Democrats argue is insufficient to address potential conflicts of interest stemming from President Trump's substantial earnings in the crypto sector.
According to a financial disclosure, Trump earned approximately $1.4 billion from crypto-related activities during the first year of his second term. This has intensified calls from Democrats for stronger safeguards against conflicts of interest. The bill's passage odds have decreased significantly, with prediction markets estimating a 39% chance of approval, down from over 80% earlier in the year.
The Senate's limited schedule and procedural challenges further complicate the bill's progress, with the upcoming recess posing additional timing hurdles.
