NYC Mayor Mamdani Considers Legal Authority to Arrest Netanyahu

By Marcus Ellison

New York City Mayor Zohran Mamdani has disclosed that he is in ongoing discussions with the city's Law Department to determine whether he possesses the legal authority to arrest Israeli Prime Minister Benjamin Netanyahu if he visits New York City. This revelation was made during an interview with The New York Times on July 18, 2026.

Mamdani's inquiry into the legal feasibility of such an arrest stems from a campaign pledge to honor the International Criminal Court's (ICC) arrest warrant for Netanyahu, who has been charged with war crimes. However, significant legal barriers exist, as the United States is not a party to the ICC, and the court holds no jurisdiction on American soil.

During his mayoral campaign, Mamdani emphasized his commitment to operating within legal boundaries, despite advocating for the enforcement of international law. He has labeled Netanyahu a 'war criminal' and expressed his intent to direct the NYPD to act if Netanyahu were to enter the city.

Legal experts have pointed out that diplomatic immunity and federal supremacy over foreign affairs likely preclude any local enforcement action against a sitting foreign leader. As of now, no definitive authority or plan has been confirmed by the NYC Law Department or other governmental entities.
